The Supreme Court has been taking up numerous important cases over its recent session. Not every decision it made has pleased Americans. But the consequences of the court’s rulings will affect the country for years to come.

The court has decided to take up a case that could upend a plot being pushed by Democrats for years.

The case will require the court to interpret a law being used to prosecute hundreds of Americans. If the court rules the way the defendant wants, it could spoil plans the left is using to take down many conservatives, including Donald Trump.

The case, Fischer v. United States, asks the Supreme Court to weigh the scope of an obstruction statute, Section 1512(c)(2), which penalizes anyone who corruptly “obstructs, influences, or impedes any official proceeding” with up to 20 years in prison. Joseph Fischer, who entered the Capitol on Jan. 6, argues that his prosecution under the law for obstructing Congress’ certification of the 2020 election was an “unprecedented expansion” of the statute.

Joseph Fischer is one of many Americans being prosecuted by Biden’s DOJ over the events of January 6, 2021. He is arguing that the law being used to prosecute him is misapplied and that the DOJ is making an “unprecedented expansion.”

The law is part of the Corporate Fraud and Accountability Act of 2002. This bill was intended to prevent evidence tampering over fraud cases coming out of the corporate world. It appears that part of the law prevents someone from obstructing an official proceeding, in an attempt to tamper with evidence.

Yet this part of the law is being used to prosecute Americans over a case that has nothing to do with corporate fraud. Fischer argues that the law was not intended to be used against Americans entering a government building.

But it is up to the Supreme Court to decide if prosecutors can use this statute against Fischer and presumably all the other J6 defendants.

If the court rules that the DOJ cannot use this law to prosecute Fischer, it might derail all the other pending cases. The left’s entire plan to go after conservatives who were present on January 6 could fall apart. It might even give Trump’s legal team to dismiss Jack Smith’s prosecution against him.

It all depends on how the court rules.
