The Supreme Court made history this week. It ruled on a much-debated issue: presidential immunity. While legal pundits are working out the court’s decision, we do know that the court maintains that presidents enjoy complete immunity for official decisions.
That will have serious implications for the Democrat-run criminal cases against Trump. Already, experts are saying the cases from federal prosecutors and Georgia will be thrown out.
Last month, a New York court convicted Trump of a “hush money” scheme dating back to 2016. But with this new decision in view, Trump is making a big demand on the courts. Democrats won’t like this, but Trump’s team is making a strong argument.
From the New York Times:
Donald J. Trump began an effort on Monday to throw out his recent criminal conviction in Manhattan and postpone his upcoming sentencing, citing a new Supreme Court ruling that granted him broad immunity from prosecution for official actions he took as president, according to a person with knowledge of the matter…[Trump’s] lawyers are likely to argue that prosecutors built their case partly on evidence from his time in the White House. And under the Supreme Court’s new ruling, prosecutors not only may not charge a president for any official acts, but also cannot cite evidence involving official acts to bolster other accusations.
Donald Trump is demanding the court to throw out the New York criminal conviction and for his sentencing to be postponed. Democrats have been almost giddy with the prospect of Trump being sent to jail or at least confined to house arrest—ending his campaign traveling.
But with the new Supreme Court ruling, Trump has grounds to get this conviction thrown out. That would require more deliberating, which should push back his sentencing. Given how soon the election is, this could end Democrats’ dreams of Trump being locked up before November.
As outrageous as this sounds to some, it looks like Trump might get part of what he wants. The infamous DA behind the prosecution appears to be turning a cowardly green.
From Fox News:
Manhattan District Attorney Alvin Bragg told Judge Juan Merchan Tuesday that he does not oppose former President Trump’s request to delay his sentencing scheduled for next week…“Although we believe defendant’s arguments to be without merit, we do not oppose his request for leave to file and his putative request to adjourn sentencing pending determination of his motion.”
It sounds like Bragg has lost all the wind in his sails. With this Supreme Court ruling, Democrats might have run out of lawfare ammunition. If the ruling means Trump can’t be prosecuted for what he did while in office, then this latest scheme by the left is totally destroyed.
With Biden fumbling in the polls, Democrats might be unable to undermine the election.
Key Takeaways:
- Donald Trump filed for his New York conviction to be thrown out and for the sentencing to be pushed back.
- This comes in light of the Supreme Court’s historic ruling that presidents enjoy immunity for official acts in office.
- DA Bragg did not oppose Trump’s request for a delay in sentencing.
- The court’s ruling might destroy the Democrat’s lawfare campaign against Donald Trump.
