The border crisis has hit the state of Texas harder than any other. Because it shares the longest border with Mexico, many of the migrants illegally entering the country are coming through the Lone Star State.
Republican Gov. Greg Abbott has declared the crisis an “invasion.” He has implemented various methods to repel the so-called invaders.
But the federal government, under President Biden, has appeared to go to extraordinary lengths to stop Texas from preventing illegal immigration. And now, the governor has vowed to take this battle to the highest court in the land.

On December 1, the Fifth Circuit Court of Appeals sided with a prior district court ruling that had ordered Texas to remove the floating razor wire barriers it installed to prevent migrants from crossing the Rio Grande and entering the United States illegally…In a statement on X, Governor Greg Abbott called the decision “clearly wrong,” and vowed that he and Attorney General Ken Paxton would “seek an immediate rehearing by the entire court.”
“We’ll go to SCOTUS if needed to protect Texas from Biden’s open borders,” he added.
A federal court ordered Texas to remove barriers in the Rio Grande meant to discourage illegal immigration. The Rio is a major means by which migrants illegally enter the country. And it appears these barriers, equipped with razor wire, have successfully deterred entry.
Gov. Abbott announced he and the attorney general will seek an “immediate rehearing” by the entire court. But if the Fifth Circuit refuses to allow the state to defend its border, Abbott vowed to take the case to the Supreme Court.
Many Americans have been waiting for the Supreme Court to wade into the immigration debate. A few cases are pending before the court, but how the SCOTUS rules could either save border states or give Biden a major victory.
An old Supreme Court ruling prohibited states from deporting migrants. It is possible a future case could give the court the opportunity to overrule this decision, allowing Texas authorities to remove illegal border crossers.
The governor is also advancing a law that will allow all Texas law enforcement, including local police, to apprehend illegal aliens.
Texas has been successful at reducing the number of migrants crossing the border. But migrants have only flooded Arizona and California, whose liberal leaders appear to be doing nothing.
