On election day, the Senate race in Pennsylvania is one of the closest and most-watched in the country.

Lt. Gov. John Fetterman is locked in a neck-and-neck race with Republican challenger Dr. Mehmet Oz.  Fetterman recently gained the backing of both President Joe Biden and VP Kamala Harris.

And now, the Democrat is making a last-second move.

Mail-in balloting continues to come under heavy scrutiny, as many Americans still don’t trust the process. It has also been the subject of numerous court cases in recent months.

One of the biggest issues involves mail-in ballots with mistakes; for example, undated or misdated envelopes.

Most courts are saying that such ballots shouldn’t be counted for the sake of accuracy and election integrity. But Democrat leaders contend that such “trivial” mistakes shouldn’t invalidate the vote.

Unsurprisingly, Fetterman is on that side, so he’s suing to allow for the counting of ballots with errors.

Lt. Gov. John Fetterman’s campaign for U.S. Senate sued Pennsylvania election officials, asking a federal judge to allow the counting of problematic mail-in ballots.

The Democrat’s campaign was joined by the Democrats’ U.S. House and Senate campaign arms and two Democratic voters in Erie County who submitted mail ballots in undated or misdated envelopes to file suit in federal court in Pittsburgh, according to the Philadelphia Inquirer.

The lawsuit claims that the state shouldn’t “arbitrarily reject” ballots, and that the rule “imposes unnecessary hurdles” for voters.

The plaintiffs further argue that the rule is in violation of the 14th Amendment because  “a state cannot utilize election practices that unduly burden the right to vote.”

This is a hotly debated issue. The PA Supreme Court was deadlocked on the topic last week, but still ordered that election boards not count mailed ballots with incorrect or missing dates.

It does appear as if people have problems with the ballots, too:

The Examiner reports that about 3,500 voters in Philadelphia have “at least one of four problems” on their ballot. This could be a missing signature or date, or a “naked ballot”  without an envelope.

Fetterman has watched a large lead dwindle in the past couple of months.

Some question his mental fitness after his stroke, while others don’t like his soft-on-crime policies. On the flip side. Dr. Oz has surged in the polls, and now it looks like he has a real chance.
