The case was filed by John Anthony Castro from Texas, who says he is a presidential candidate, according to the West Virginia Record. He reportedly argued that Trump being on the ballot would harm his chances at a 2024 win.

A Texas Republican named John Anthony Castro sued in West Virginia to remove Trump from the ballot. The man claimed he was running for president. He has not appeared at any GOP debates and does not seem to be polling well.

He claimed that Trump was not qualified to run, using the same 14th Amendment claim used by many Democrats. And he argued that with Trump on the ballot, it would take votes away from Castor and other candidates.

But the judge dismissed the case, dashing Castro’s chances of getting Trump removed. The judge decided Castro had no standing to sue Trump. He could not factually prove that with Trump off the ballot, voters would choose him.
