Federal Court Strikes Down Major Biden Policy – Judge Claims Administration Violated Congressional Law at the Border

For years now, the Biden administration has faced legal hurdles related to the ongoing border crisis.

Southern state leaders have leveled numerous lawsuits at the federal government, claiming Biden’s team hasn’t upheld existing immigration law. This has led to record-breaking surges at the southern border.

Now, a federal judge has agreed in one case — and he just struck down a big Biden policy.

In September of 2021, Florida Attorney General Ashley Moody hit the Biden admin with a lawsuit, accusing the federal government of illegally allowing the mass release of undocumented migrants in the U.S.

Many of those migrants wound up in Florida, and Moody alleged that this entire issue violates Congressional law.

The law simply mandates detention upon entry, and is quite clear in its wording. And the judge presiding over this case saw it the same way, and added some harsh words for the Biden administration, too.

Via The Daily Caller:

A federal judge has struck down a Biden administration immigration policy that allows the release of illegal aliens at the border, saying it ‘effectively turned the Southwest Border into a meaningless line in the sand.’

The policy, he said, turns the border into ‘little more than a speedbump for aliens flooding into the country by prioritizing ‘alternatives to detention’ over actual detention and by releasing more than a million aliens into the country…

Judge T. Kent Wetherell ruled in favor of Florida and found the Parole and Alternative to Detention (Parole + ATD) policy is, in fact, illegal.

Wetherell added that the “unprecedented surge of aliens” that began the instant Biden took office “has continued unabated over the past two years.”

On top of that, the judge said there’s evidence to show that over 100,000 illegal immigrants wound up in Florida, which has caused financial and stability problems for the state (as it does for the entire country).

In response to the ruling, Moody replied:

Today’s ruling affirms what we have known all along, President Biden is responsible for the border crisis and his unlawful immigration policies make this country less safe.

A federal judge is now ordering Biden to follow the law, and his administration should immediately begin securing the border to protect the American people.

This will be widely viewed among Republicans and Conservatives as a significant victory in the battle for our national security.

The Biden administration has 7 days to appeal this ruling, but nobody knows if they will.

With over one million illegal migrants flooding into the country in 2022 and more anticipated in 2023, with record-shattering weeks and months, it seems to many as if there’s absolutely no border control at all.

This simply can’t be allowed to continue — and at least one judge has pushed back against the Biden administration.

Key Takeaways:

  • A federal judge ruled that one of Biden’s biggest border policies is unlawful.
  • The Judge ruled in favor of the state of Florida, and added that the policy was “little more than a speedbump for aliens flooding into the country.”
  • Florida AG Ashley Moody celebrated the decision, saying it confirmed that “President Biden is responsible for the border crisis.”
